Description:PARALEGAL IN FIDUCIARY LITIGATION
Position Overview: A Paralegal in Fiduciary Litigation plays a key role in assisting the attorney with legal tasks related to fiduciary disputes, such as those involving trusts, estates, guardianships, and other fiduciary responsibilities.
This role is ideal for someone with strong attention to detail and an interest in fiduciary law and litigation. The Paralegal will work closely with the attorney to ensure the smooth progression of cases and assist in achieving favorable outcomes for clients.
This is a detail-oriented position, and the candidate is required to focus on each task as she or he completes the work. This is not a job for a multi-tasker, but for an individual who can be present and engaged with each task at hand.
We are looking for a self-starter who enjoys tracking tasks, investigating further actions, and ensuring that each is complete and correct, without constant supervision.
Key Responsibilities:
1. Legal Research:
o Conduct research on fiduciary law, case law, statutes, regulations, and other legal matters relevant to the case.
o Stay updated on changes in fiduciary-related laws and legal precedents.
2. Document Preparation & Drafting:
o Draft and prepare legal documents including petitions, motions, discovery requests, and responses related to fiduciary disputes.
o Assist in drafting correspondence and legal memoranda.
o Prepare exhibits and binders for depositions, mediations, hearings and trials.
3. Case Management:
o Organize and maintain case files, ensuring all documents are properly filed and updated in a timely manner.
o Track deadlines for filings, court dates, and other important case events.
o Coordinate the gathering of evidence and relevant documentation from clients, witnesses, and third parties.
4. Discovery Assistance:
o Assist in the discovery process by preparing and managing requests for documents, interrogatories, and depositions.
o Review and analyze discovery responses, tracking key information and discrepancies.
5. Client Interaction:
o Communicate with clients to gather relevant information, explain procedural steps, and update them on case progress.
o Coordinate meetings with clients, experts, and witnesses.
6. Court Filings:
o File documents with the court and ensure compliance with court rules and deadlines.
o Prepare and organize filings for probate and estate court proceedings.
o Assist with case preparation for depositions, mediations, hearings, and trials.
7. Administrative Support
o Prepare mailings;
o Create cases;
o Complete other administrative tasks.
8. Legal Billing and Timekeeping:
o Track billable hours and assist in billing clients for work performed.
o Draft invoices and email to clients.
Qualifications:
Education: Associate's degree in paralegal studies or a related field. A Paralegal Certificate is a plus.
Experience: Minimum of 2-3 years of experience in fiduciary litigation or similar practice areas (such as estate, trust, or probate law).
Skills:
o Excellent legal research and writing skills.
o Proficiency with case management software, MyCase, and Microsoft Office Suite (a must have).
o Strong organizational skills and attention to detail.
o Experience with probate court filings and procedures.
o Ability to work independently and in a team environment.
o Professional and courteous communication skills, both written and verbal.
Preferred:
Strong knowledge of fiduciary law, including trust administration, estate planning, and related legal procedures.
Knowledge of e-filing systems and case management software.
